Ellingthorpe was found guilty at York Assizes in Aug 1772 of an assault with intent to commit sodomy, fined £20, imprisoned for two years and to find sureties for his good behaviour. Public Advertiser Friday 154 Aug 1772, issue 11078. His conviction was also reported in the General Evening Post, Tuesday 11 Aug 1772, issue 6059, and London Evening Post Thursday 13 Aug 1772, issue 6960, but he is not named in these reports.
